Terms of Service
These terms are a binding agreement between you and 20 Minute Production LLC covering your use of XSTARME. Please read section 13 — it contains an arbitration agreement and a class-action waiver that affect how disputes are resolved.
1. Who we are and what this covers
XSTARME (the “Site”) is operated by 20 Minute Production LLC, of [set COMPANY_ADDRESS in config.php] (“we”, “us”, “our”). The Site offers immersive 360° adult video, with paid subscriptions to individual performers (“Talent”).
By accessing the Site, creating an account, or purchasing a subscription, you accept these Terms of Service (“Terms”), our Privacy Policy, our Cookie Policy, and our Refunds & Cancellation Policy. If you do not accept them, you must leave the Site.
2. Age restriction and eligibility
The Site contains sexually explicit material intended solely for adults. By entering, you represent and warrant that:
- you are at least 18 years old, or the age of majority in your jurisdiction, whichever is higher;
- viewing sexually explicit material is lawful where you are located and where you access the Site;
- you are not accessing the Site from any jurisdiction where adult content is prohibited, and you will not make the content available to minors or to anyone who has not consented to view it;
- you will not use the Site in any workplace or public place where it may be seen by others without their consent;
- you are viewing the material for your own personal use and are not acting as an agent of any government or investigative body seeking to use it against us.
We may require verification of age or identity at any time, and may suspend access pending verification. Providing false information about your age is a material breach of these Terms.
3. Your account
Some features require an account created with an email address and a password. You must keep your credentials confidential and are responsible for all activity under your account. Accounts are personal to you: you may not share, sell, transfer, or allow others to use your account or subscriptions.
Notify us at support@xstarme.com immediately if you believe your account has been accessed without authorisation. We may suspend or close an account that we reasonably believe is shared, compromised, used fraudulently, or used in breach of these Terms.
4. Subscriptions, billing and auto-renewal
4.1 What you are buying
Subscriptions on XSTARME are per Talent. Subscribing to one performer gives you streaming access to that performer’s scenes only, for as long as the subscription is active. It does not give access to other performers, and it does not transfer any ownership of the content. Without a subscription you can view a short free preview of each scene.
4.2 Term, renewal and price
Subscriptions are offered on a weekly or monthly billing cycle, as shown on the Talent’s page at the time of purchase. Subscriptions renew automatically at the end of each billing period, at the then-current price, and you will be charged on each renewal date until you cancel. The price, currency, billing frequency, and applicable taxes are displayed to you at checkout before you pay.
We may change subscription prices. Price changes take effect on your next billing period, and we (or Paddle) will give you reasonable advance notice by email. If you do not accept a new price, you may cancel before it takes effect.
4.3 Who processes your payment
Our order process and payments are conducted by our online reseller and merchant of record, Paddle.com Market Ltd and its affiliates (“Paddle”). Paddle is the seller of record for your purchase, handles the transaction, collects and remits applicable sales tax and VAT, and provides billing support. Your purchase is therefore also subject to Paddle’s buyer terms and privacy notice, presented at checkout. We never receive or store your card number.
4.4 Cancelling
You can cancel at any time, with no cancellation fee, using the subscription-management link in the receipt Paddle emailed you, or by emailing support@xstarme.com and asking us to cancel for you. Cancellation stops future renewals; your access continues until the end of the period you have already paid for and is not pro-rated. 4.5 Failed payments
If a renewal payment fails, Paddle may retry it. We may suspend or end access to the relevant Talent’s content if the payment is not completed.
5. Licence to use the content
Subject to these Terms and to an active subscription where required, we grant you a limited, personal, non-exclusive, non-transferable, revocable licence to stream the content for your own private, non-commercial enjoyment. All other rights are reserved.
You must not:
- download, record, screen-capture, rip, cam, mirror, scrape, or otherwise copy or store the video, audio, images, or stream;
- circumvent, disable, or interfere with any access control, encryption, key delivery, paywall, watermark, or other protective measure;
- reproduce, republish, sell, rent, sub-licence, broadcast, publicly perform, or make the content available to anyone else, including on tube sites, file lockers, messaging groups, or social platforms;
- use the content to train, fine-tune, or evaluate any machine-learning or generative AI system, or to create deepfakes, face swaps, or other synthetic depictions of any person appearing on the Site;
- use automated means (bots, crawlers, harvesters) to access the Site, or use the Site to send spam or malware;
- attempt to gain unauthorised access to the Site, other users’ accounts, or our systems, or probe, scan, or test their security;
- remove, obscure, or alter any copyright, trademark, watermark, or other proprietary notice.
Unauthorised copying or redistribution of adult content is a serious matter: it infringes copyright, may violate the performers’ rights of publicity and privacy, and we pursue it. We may suspend accounts, block access, and take legal action, including seeking damages and injunctive relief.
6. Intellectual property
The Site, its design, software, trademarks, and all video content are owned by us, by the Talent, or by our licensors, and are protected by copyright, trademark, and other laws. Nothing in these Terms transfers any intellectual property right to you.
7. Content on the Site and performer consent
All performers appearing in explicit content on the Site were at least 18 years old at the time of production, verified by government-issued photo identification, and consented in writing to the production and distribution of that content. Records are maintained as described in our 18 U.S.C. 2257 Statement.
We prohibit, and do not knowingly host, content involving minors, non-consenting persons, coercion, trafficking, or non-consensual distribution of intimate images. If you believe any content on the Site infringes your rights, depicts you without your consent, or should be removed for any other reason, use our Content Removal & DMCA process — we act on those reports quickly.
8. User conduct and submissions
You must use the Site lawfully and respectfully. You must not harass, threaten, stalk, dox, defame, or impersonate any performer, user, or member of our staff, and you must not attempt to contact performers through the Site for unlawful purposes.
If you send us feedback, suggestions, or other materials, you grant us a non-exclusive, worldwide, royalty-free licence to use them without obligation to you. Do not send us anything you consider confidential.
9. Availability, changes, and third-party links
We aim to keep the Site available, but it is provided on an “as available” basis. We may modify, suspend, add, or withdraw features, scenes, performers, or the whole Site at any time, and we perform maintenance that may cause interruptions. Streaming quality depends on your device and internet connection, which are your responsibility. Content libraries change over time; a scene or performer being available when you subscribe is not a guarantee that it will remain available.
The Site may link to third-party sites. We do not control them and are not responsible for their content or practices.
10. Suspension and termination
You may stop using the Site at any time and may ask us to close your account by emailing support@xstarme.com. We may suspend or terminate your account or access, with or without notice, if you breach these Terms, if we are required to do so by law, or if we reasonably believe your use is fraudulent, unlawful, or harmful to others.
If we terminate your account for a breach that you caused, you are not entitled to a refund of amounts already paid. If we terminate for any other reason, we will refund any unused portion of a paid period. Sections 5–7 and 11–14 survive termination.
11. Disclaimers
To the fullest extent permitted by law, the Site and the content are provided “as is” and “as available”, without warranties of any kind, whether express, implied, or statutory, including implied warranties of merchantability, fitness for a particular purpose, title, non-infringement, and any warranty that the Site will be uninterrupted, timely, secure, or error-free. Content on the Site is adult entertainment involving performances; it is not instructional, medical, or advisory material.
Some jurisdictions do not allow the exclusion of certain warranties, so parts of this section may not apply to you, and nothing here limits rights you have as a consumer that cannot be waived by law.
12. Limitation of liability
To the fullest extent permitted by law, neither we nor our officers, employees, or suppliers will be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, or for lost profits, lost data, or loss of goodwill, arising out of or relating to your use of, or inability to use, the Site — even if we have been advised of the possibility.
Our total aggregate liability arising out of or relating to these Terms or the Site is limited to the greater of (a) the amount you paid us in the twelve months before the event giving rise to the claim, or (b) US$100.
Nothing in these Terms excludes or limits liability for fraud, fraudulent misrepresentation, death or personal injury caused by negligence, or any other liability that cannot lawfully be excluded.
13. Governing law and dispute resolution
These Terms are governed by the laws of the State of Delaware, United States, without regard to conflict-of-laws rules.
13.1 Talk to us first
Most problems can be resolved quickly. Before starting formal proceedings, please email support@xstarme.com with a description of the issue and the resolution you want. We will try in good faith to resolve it within 30 days.
13.2 Binding arbitration and class-action waiver
If we cannot resolve a dispute informally, you and we agree that any dispute arising out of or relating to these Terms or the Site will be resolved by final and binding individual arbitration administered under the rules of a recognised arbitral body, seated in Delaware, rather than in court. You and we each waive the right to a jury trial and to participate in a class, collective, or representative action.
Exceptions: either party may bring an individual claim in small-claims court, and either party may seek injunctive relief in court to protect intellectual property or stop unauthorised access. If you are a consumer resident in the European Union, the United Kingdom, or any other jurisdiction where a pre-dispute arbitration agreement or class-action waiver is unenforceable, this section 13.2 does not apply to you, and you may bring proceedings in the courts of your country of residence under the mandatory consumer-protection law that applies to you.
14. General
Changes. We may update these Terms. We will change the “last updated” date above and, for material changes affecting your rights or your subscription, give notice by email or on the Site before they take effect. Continuing to use the Site after that means you accept the new Terms; if you do not, cancel and stop using the Site.
Severability. If any provision is found unenforceable, the rest remains in force.
No waiver. If we do not enforce a provision, that is not a waiver of our right to do so later.
Assignment. You may not assign these Terms. We may assign them to an affiliate or in connection with a merger, acquisition, or sale of assets.
Entire agreement. These Terms, together with the policies linked in section 1, are the entire agreement between you and us about the Site.
